Bullying and Harassment
Bullying claims are able to be determined by the Fair Work Commission from 1 January 2014, and they have wide ranging powers to issue orders to stop the bullying behaviour or issue orders to stop workplace bullying which if breached can attract significant financial penalties.
Bullying occurs when:
- a person or a group of people repeatedly behaves unreasonably towards a worker or a group of workers at work
- the behaviour creates a risk to health and safety
Where bullying and harassment occurs or is claimed, it is essential to engage a professional such as Leigh who can manage all aspects of the claim, and to minimise the potential outcomes which can be disruptive to employers and damaging to individuals involved.
This may include workplace investigations, representation where Trade Unions are involved, Mediation and Arbitration, all of which Leigh is skilled and qualified to perform.
Leigh can also provide training, policies and procedures on this complex issue to assist with compliance requirements and reduce the likelihood of claims occurring.
There are crucial procedural steps, eligibility requirements and timelines that apply to these matters and claims, which if ignored or mismanaged can dramatically effect the ability to lodge or defend a claim and the potential settlement outcomes.
