Bullying and Harassment

Bullying claims are able to be determined by the Fair Work Commission from 1 January 2014, and they have wide ranging powers to issue orders to stop the bullying behaviour or issue orders to stop workplace bullying which if breached can attract significant financial penalties.

Bullying occurs when:

  • a person or a group of people repeatedly behaves unreasonably towards a worker or a group of workers at work


  • the behaviour creates a risk to health and safety
